Tos (Term of Service)
Worria Affordable Web Hosting agrees to provide service to the customer, subject to the following TOS (Term of Service)
This document is between you ("Customer") and Worria Affordable Web Hosting
1.0 Service Description
(a) In consideration of your payment and your commitment to abide by the terms and conditions outlined in this agreement. Worria Affordable Web Hosting agrees to provide Internet Service as stated in the order form.
(b) Pricing and term for additional service are outside the scope of this agreement and are to be negotiated separately.
(a) The term in this agreement shall be month-to-month unless otherwise stated in the order form for our shared accounts. At the end of the term, this agreement shall automatically renew for the same term at the currently stated rate by Worria Affordable Web Hosting unless otherwise requested by the Customer and agreed upon by Worria Affordable Web Hosting.
(b) Worria Affordable Web Hosting reserves the right to modify the terms and conditions of service with notification of the effective date of change.
(a) Customer agrees to pay for the web hosting and Internet service outlined on this page.
(b) Customer agrees to pay the nonrecurring set-up charges, first instalment of payment option, monthly recurring charges, and any applicable taxes upon signing Service agreement.
4.0 Billing/ Payment Policy
(a) All payment shall be paid in Hong Kong Dollar (HKD), Great Britain Pound (GBP) or United States Dollar (USD). If any payment obligation is not paid in a timely manner, the customer agrees and promises to pay all costs of collections, including reasonable attorney fee, whether or not a lawsuit commerce as part of the collection process.
(b) Worria Affordable Web Hosting will bill the customer automatically on a monthly, quarterly, or annually basis on the sign-up anniversary date (plus tax, if applicable) depends on the payment option the customer chose at time of sign-up. Receipt for payment will be emailed to customer.
(c) If any of the following event of default occur, this agreement and any other obligation of the customer to Worria Affordable Web Hosting, shall become due immediately, without demand or notice:
i. The filing of bankruptcy processing involved the customer as debtor.
ii. The application or appointment of a receiver for the Customer's creditors.
iii. The making of a general assignment for the benefit of the Customer's creditors.
iv. The insolvency of the credit, or
v. The misrepresentation by the Customer to Worria Affordable Web Hosting for the purpose of obtaining or extending credit.
(d) If determined by Worria Affordable Web Hosting that the account should be suspended for any reason, including but not limited to non-payment of account, the customer agrees to pay a reinstatement fee of a hundred and sixty Hong Kong dollars (HKD$160.00) to reactivate the account.
(e) Payment are due on one week after the sign-up anniversary date, and charges outstanding more than five (5) days after the pay date will be assessed a late payment fee of $1.5% of unpaid balance due per month.
(f) Cancellations made within fourteen (14) days from the date for of signing up will fall under our fourteen (14) days risk free policy. Set-up fees and other nonrecurring charges are non-refundable. Cancellations received ten (10) days after the beginning of a new billing period will be eligible for a pro rate refund based on the days of service remaining under the initial service period paid. Notice of cancellation must be send an email to firstname.lastname@example.org or send mail to our office (address stated on http://worria.com/contactus.shtml) in order to be accepted by Worria Affordable Web Hosting.
(g) Overages in customers monthly allowed bandwidth usage will incur an extra charges of thirty-nine Hong Kong dollars (HKD$27.00) per gigabyte, customers whom continually have monthly overages will be advised to upgrade to a new plan or dedicated solution.
5.0 Allowance for Interruptions/ Limitation of Liability
(a) In no case shall Worria Affordable Web Hosting, its officers, or any of its representatives be held responsible for any consequential damages or loss resulting either directly or indirectly from any activity on our network. Worria Affordable Web Hosting is also to be known as a Common Carrier and as such is not responsible for the content, lack of content, accuracy, or inaccuracy of any information gathered from Customers use of this network. All information is provided as-is without regard to fitness-of-purpose.
(b) Worria Affordable Web Hosting shall not be held liable for any special, incidental, consequential or punitive damages of any kind, including but not limited to loss of business opportunity or loss of profits.
6.0 New Domains/ Transfer of Domains
(a) Any new account(s) involving new Domain registration will be registered immediately upon authorization through Worria Affordable Web Hosting. New Domain will be entered into our DNS servers within two (2) business days. Please note that it normally takes two (2) to five (5) days for DNS to resolve to the Internet.
(b) Any new account(s) involving Domain Transfer from another provider to Worria Affordable Web Hosting will require a minimum of five (5) days to be transferred and entered into our DNS servers. Due to the unpredictable nature of the transfer process, Worria Affordable Web Hosting makes no guarantees regarding the amount of time a specific transfer process may take. Worria Affordable Web Hosting will make every effort to try and expedite the transfer process on behalf of the Customer where possible.
7.0 Support Limitations
(a) Worria Affordable Web Hosting provide 24x7 365/ days a year support to our Customers. We limit our technical support to our area of expertise and our guidelines for providing support are limited to your Virtual Site functioning and services. Worria Affordable Web Hosting will not attempt to assist with application specific issues such as: PERL, CGI, HTML and PHP programming however if you feel it is an error due to a service problem we will investigate it.
(b) If an issue should arise that require the assistance of support, the following guidelines should be followed in order to provide satisfactory results.
1. Before filling out a trouble ticket or using our live chat option, please take the time to look at our FAQ (Frequently Asked Questions) in http://worria.com/script/FAQ.php or our forum in http://vb.worria.com/ to see if the issue has been previously addressed. Please note these are updated frequently so please check often.
2. Enter the appropriate trouble ticket at Worria Affordable Web Hosting support desk. This is necessary in order to track problems for resolution and possible billing credit issues. Please do not use our forum for official support issue. Please fill out a trouble ticket.
8.0 Security Patches/ Service Upgrades
(a) Worria Affordable Web Hosting will install, upgrade, or patch all available service with the recommended security patches as deemed necessary. All patches and upgrades will be applied in a timely manner after release usually within one (1) to five (5) days. This service is available to all of our Shared Clients and is included in your monthly fees.
(b) Worria Affordable Web Hosting will install, upgrade, or patch all available service with newer versions release by the author as deemed necessary. These will be applied on a less frequent basis, usually bi-monthly, to avoid interruption in Network Service. This service is available to all of our Shared Client, and is performed at no charges to the Customer. This does not include O/S (Operating System) upgrades unless determined to be a Security enhancement or necessary task.

9.0 Data Back-ups
(a) Worria Affordable Web Hosting performs weekly back-ups on all our Shared servers to ensure critical system files are never lost. Weekly back-ups of user directories and data are also performed. However, Worria Affordable Web Hosting will not restore any file(s) or directory(s) and data that a Customer or a user has accidentally deleted or modified.
(b) The back-ups restoration is for emergency purposes only. The Customer is advised to back-up all of their own files to their local hard drive. Worria Affordable Web Hosting is NOT responsible for lost data due to faulty or non-existent back-ups.
10.0 Licensing and OwnershipWorria Affordable Web Hosting retains all licenses and Ownership rights to all pre-installed commercial scripts, control panels, and licenses key's. This includes all our Shared plans where applicable. Except in such a case that the Customer has purchased or supplied their owns.
